Terms of Service

Xminds lets you hold text, voice and video conversations with AI mentors modelled on historical figures. Conversations are generated by third-party language and speech models on the basis of a persona description and your input.

The mentors are not real people. Nothing they say is a statement by, endorsement of, or affiliation with any real individual, their descendants or their estate.

Some features are available without an account. To save conversations, favourites and longer voice calls you need a free account. You must provide accurate information, keep your login credentials and magic links confidential, and be at least 16 years old (or the minimum age of digital consent in your country) to register.

You are responsible for all activity that happens under your account.

You agree not to:

• use the service for anything unlawful, harmful, abusive or deceptive;
• attempt to bypass usage limits, security controls or authentication;
• scrape, mass-download or resell generated content, or use it to train competing models;
• upload content you have no right to share, or personal data of other people;
• present mentor answers as genuine statements of the historical person.

We may suspend or terminate accounts that violate these rules or put the service at risk.

AI output can be wrong, biased, outdated or invented, including invented quotations. Always verify anything important with primary sources. The service does not provide medical, legal, financial, or psychological advice and is not a substitute for a qualified professional. In an emergency, contact local emergency services.

You are responsible for how you use the output. To the extent permitted by law, you own the conversations you create; we may use anonymised, aggregated usage data to improve quality and reliability.

Guest and free accounts include daily message and call limits, which we may adjust to keep the service sustainable. We may add, change or discontinue features at any time. Current limits for each plan are shown on our pricing page.

Xminds Pro is a subscription that renews automatically each month or year until you cancel. The price, billing period and included allowances are shown before you purchase and again in your settings. Pro allowances are subject to fair use and to the daily and monthly limits stated at the time of purchase; we may adjust them with reasonable notice.

Fair use: Pro includes unlimited messages for normal personal use. Automated, scripted or otherwise excessive use — including an excessive number of messages or an excessive amount of voice-call time in a month — is not covered, and we may throttle or suspend accounts that go far beyond ordinary human use.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, invoicing, taxes and refunds are governed by the Paddle Buyer Terms and the Paddle Refund Policy.

You can cancel at any time in your settings. Cancellation takes effect at the end of the period you have already paid for; your account then returns to the free plan and your saved conversations remain available. We do not pro-rate partial periods.

We offer a 30-day money-back guarantee: if you are not satisfied, request a refund within 30 days of your order through Paddle at paddle.net or by writing to hello@xminds.app.

If you are a consumer resident in the EU or EEA, you have the right to withdraw from a subscription within 14 days without giving reasons. To exercise it, send a clear statement to hello@xminds.app or use Paddle at paddle.net.

Because Pro is a digital service that starts immediately, by completing the purchase you expressly request that we begin performance during the withdrawal period and acknowledge that you lose your right of withdrawal once the service has been fully performed. Independently of this, our 30-day money-back guarantee above still applies.

The Xminds name, logo, interface, mentor artwork, intro videos and curated content belong to Elite Startups Management GmbH or its licensors. You receive a limited, non-exclusive, non-transferable right to use the service for personal, non-commercial purposes.

The service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect or consequential damage, lost profits or lost data. Nothing in these terms excludes liability that cannot be excluded by law, including for intent, gross negligence or injury to life, body or health.

You can delete your account, including all saved conversations, yourself at any time under settings — no email to us required. We may terminate or restrict access for material breaches of these terms. Sections that by their nature survive termination (intellectual property, liability, governing law) remain in force.

We may update these terms when the service changes or the law requires it. Material changes will be announced in the app or by email before they take effect. Continuing to use Xminds after that date means you accept the updated terms.

When using the AI features of Xminds, you must not:

• generate content that is illegal, hateful, harassing, sexual, violent or that promotes self-harm;
• create deepfakes, impersonate a real living person, or present mentor output as a genuine statement, recording or endorsement of a real person;
• attempt to jailbreak, prompt-inject or otherwise circumvent the safety instructions and usage limits of the service;
• generate malware, fraud or spam content, or use output to deceive, defame or manipulate others;
• input content, images or personal data you have no right to use.

You are responsible for your prompts, for how you use the output, for verifying its accuracy, and for holding the rights to anything you provide as input. We may filter, refuse or remove outputs, and suspend or terminate accounts, where these rules are breached.

We only build personas of historical figures whose works are in the public domain, and we screen every persona against rights and likeness criteria before it is created. Our full approach is described on our Ethical AI page.

If you hold rights in a work, a name, an image or a voice and believe our content infringes them, write to hello@xminds.app with the page URL and a description of the claim. We review every notice, remove or unpublish content where the claim is justified, and repeatedly infringing accounts are terminated.
